Research Component: Term Paper

  1. Each student is required to write a term paper, which spans 10 to 15 pages (double-spaced/font 12). You are required to send An Outline, one page in length, for the paper to the instructor by week 5 (midnight/Sunday). The outline is on what you PLAN to write in your paper.

 No strict format for the paper is required except for a consistency of the format you choose. You may follow a scientific notation, For Example, (Epstein 2021, 141-5): Here, Epstein refers to the name of author, 2021 the year of publication and 141-5 to the pages on which the information you have cited. A Section for REFERENCES should be listed at the end of the paper.

Guidelines for the paper are as follows:

Choose any of the issues/challenges/developments that are related to international law (IL). Below are just enumerated EXAMPLES of topics/issues you may be interested in. Of course, you can choose your own ‘CREATIVE ‘ topic for your paper.

    • Contending theories of international relations (IR) and international law (IL)
  • Maritime delimitation, Nine-dash –line, and South China Sea
  • The Lotus Case and Jurisdiction
  • Treaties and customary international law
  • International law and domestic law
  • International organization and international law (IL)
  • ICJ and territorial disputes between states
  • Jus cogens in IL
  • Immunity from jurisdiction
  • The UN Charter and the use of force
  • “Common Article 3” of the Geneva Conventions and the US detainee policy
  • WTO and international economic order
  • UN Convention on the law of the Sea (UNCLOS)
  • Prescriptive jurisdiction
  • Doctrine of humanitarian intervention and the use of force
  • Sovereignty , Jurisdictions, and Guantanamo
  • Reservations and treaty
  • US treaty-making procedure
  • Treaties, congressional-executive agreement, and sole executive agreement in the US
  • NAFTA. WTO and congressional -executive agreements (US)
  • UN and peaceful settlement of disputes.
  • The writings of publicists and international law
  • Vienna Convention and law of treaty
  • A historical view of the development of IL
  • Diverse theories on judicial basis of IL. Etc
  1. Conduct a review of literature (cases) relevant to an analysis of the issue/event of your choice.
  2. Identify strengths/weakness as well as realty/unreality of IL in international and transnational relations.

Week 9. Final Exam/Paper Due *The final exam (unproctored) will be posted for week 9. You need to follow the guidelines required for the final exam. Paper due by Oct 9 (Midnight/Saturday).
